Greg Ford, Director of Community Development stated that David Ward with Ward Development stated that he would like to continue his request for an approval of a zoning change from C-3 Highway Commercial to R-3 Multi-Family.

§         Request for an approval of a zoning change from Agriculture to C-3 Highway Commercial for Washam Development.

Greg Ford, Director of Community Development stated this property is located at the N/W corner of Dillingham Rd. and Duncan Rd. It is a 00-acre tract that is undeveloped. The developer desires to develop this property into a commercial corner. It is bordered on the north by a creek; on the south residential; on the east future commercial; and on the west the Jackson County home for the mentally disabled.

 

Commissioner, M. Franke asked Developer if there will be more than one commercial unit.

 

Roger Cartsens with Washam Development stated that the area is approximately 2.9 acres.  They want to put in possibly a car wash, gas station and a couple of small businesses like a nail salon, etc.

Tim Schlichting stated that the request is for a C-3 Highway District and it states that description of a C-3 Highway is that this District is intended predominately for commercial activities of a service nature which typically have operating characteristics generally incompatible with retail and residential environments.  Mr. Schlichting stated he questions whether or not this is the best fit for this area.

 

Greg Ford, Director of Community Development gave descriptions of C-1, C-2 and C-3 Districts.

 

C-1 is intended primarily for office and commercial uses typically requiring locations available in the downtown portion of the City.  This district should be utilized by those businesses which will generate traffic in volumes no greater than local traffic requirements.

Greg Ford, Director of Community Development stated that a C-2 District also allows the intended use that Washam is requesting.

 

Roger Cartsens with Washam Development stated that this area is located on the North west corner of Duncan and Dillingham road.  The type of property adjacent from this location is in Jackson County where the property owner does truck repair.  There is also a tree line which would act as a buffer from the Commercial and residential.

 

Tim Schlichting, 4101 Tyer Road, Jackson County resident stated that this C-3 District is not compatible to the residential area.

 

Greg Ford, Director of Community Development elaborated on the definitions of cocktail lounge, restaurant, and night lounge for liquor sales concerns.

 

Cocktail lounge is a use engaged in the preparation and retail sale of alcoholic beverages for consumption on the premises, including taverns, bars, cocktail lounges and similar uses other than a restaurant as that term is defined in this section.

 

Restaurant (General) is an establishment primarily engaged in preparation of full course meals served with complete kitchen facilities for preparation of the food sold and where alcoholic beverages may be sold only in conjunction with meals.

 

Tim Schlichting, 4101 Tyer Road, Jackson County resident requested for Greg Ford, Director of Community Development to read again the 300 foot rule.

 

Greg Ford, Director of Community Development stated that provided the property is not less than three hundred feet from any existing school, church property and not less than three hundred feet from a residential district, measured in the shortest distance from property line to property line.

 

Chairman N. Patel asked is a C-3 an ok to place in a residential area.

 

 

Greg Ford, Director of Community Development stated that a C-3 is intended predominately for commercial activities of a service nature which typically have operating characteristics generally incompatible with retail and residential environments.  However, a majority of the concerns can be resolved with conditional use permit.

6)      Unfinished Business

§         Request for an approval of a zoning change from C-3 Highway Commercial to R-3 Multi-Family for David Ward. Refer to last months Coversheet.

Continued per Developer request.

 

7)      New Business

§         Request for an approval of a zoning change from Agriculture to C-3 Highway Commercial for Washam Development.

Motion to amend request for an approval of a zoning change from Agriculture to C-2 General Business District for Washam Development by M. Stahl, second by M. Franke.

Chairman N. Patel stated that he would like to re-visit the difference between multi-family and single family.

 

Greg Ford, Director of Community Development stated that he would have information available for the next Planning and Zoning meeting.  He also stated that the Mayor assured him that the Board of Alderman looks at each request on a case by case basis.
